Cancellation Policy

By continuing to book this trip, I acknowledge on behalf of each person participating in this activity, and furthermore agree to each of the policies and statements. RELEASE OF LIABILITY, WAIVER OF CLAIMS, AND ASSUMPTION OF RISK Lindsey’s Resort & Trout Dock – Guided Fishing Services 1. Acknowledgment of Inherent Risks Acknowledge that guided fishing on the Little Red River involves inherent risks, including but not limited to: Weather & Water: Operating in rain, wind, and varying temperatures; sudden changes in water level/current due to dam generation; and underwater hazards. Boating & Gear: Capsizing, collisions, falling overboard, and injuries from hooks, lures, or fly-casting. 2. Weather & Cancellation Policy I understand that **Lindsey’s Resort guides fish in the rain and will not cancel a trip due to rain alone. However, safety is our top priority. Trips will only be cancelled or delayed in the event of **severe weather threats** (such as lightning or high winds). I acknowledge that **trips will not supersede safety**, and the Guide has the final authority to determine if conditions are too hazardous to remain on the water. If the trip is canceled, rescheduling is provided in the way of compensation. 3. Physical Condition and Safety. I certify that I am physically fit for a boat-based fishing excursion. I agree to follow all safety instructions provided by the Guide, including the proper use of **Personal Flotation Devices (Life Jackets)**. I understand that refusing to wear a life jacket is at my own peril. 4. Release and Waiver of Liability I hereby release, waive, and discharge **Lindsey’s Resort**, its owners, employees, and independent fishing guides from any and all liability, claims, or causes of action for personal injury, death, or property damage arising out of my participation in the guided trip, whether caused by the negligence of the Releasees or otherwise. 5. Indemnification I agree to indemnify and hold harmless the Releasees from any loss, liability, or damage they may incur due to my presence on the boat or my actions during the trip. 6. Alcohol and Conduct The Guide reserves the right to terminate the trip immediately, without refund, if my conduct is deemed unsafe or if I am under the influence of alcohol or controlled substances. 7. Arkansas Law and Venue This agreement shall be governed by the laws of the State of Arkansas Reminder, booking this trip is an acknowledgement and agreement of each policy/statement.
